SPLENDERSM ONLINE SHOPPING REWARDS PROGRAM
INFORMATION COLLECTED AND HOW WE USE IT
In order to participate in the Program, we may ask you to provide us with information about you, including without limitation: (a) certain information as a condition to your participation in the Program, initially first name, last name, email address, password, and required details for your selected payment option, and (b) additional optional demographic information that will allow us to better personalize your shopping experience to make it more rewarding (e.g., gender, birth year, etc.). As a condition to your continued participation in the Program, you agree to update and maintain all such information so that it is accurate and up-to-date at all times.
We automatically log your IP address when you visit the Program website. The information logged allows us to track a member throughout their visit to the Program website. We do not use this information to capture demographic or other information; rather, it is used simply in the administration of the Program website.
The nature of the Program requires us to obtain information about your purchases at participating stores. As a result, participating stores send us transaction information (date and time of transaction, temporary ID number which only the Program can link to your account, sale amount and returned goods information) on a frequent basis. Cartera Commerce use this information to properly add cash back that you’ve earned to your Splender account (the “Program Account”).
Though we make commercially reasonable efforts to preserve member privacy, we may need to disclose personal information when required by law or we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process served on the Program website.
WHO SEES YOUR PERSONAL INFORMATION
Information that identifies you personally will not be provided to, sold or disclosed to any third party without your express permission. Within Cartera Commerce, we restrict access to your data to those employees, such as customer service representatives, who need such access to better serve you. In addition, Cartera Commerce provides limited access to third party vendors who provide financial, administrative or other services in support of the Program. These vendors are restricted from using this data in any way other than to provide services to the Program and may not use or resell the data.
You will not be able to use the Program without enabling your browser to accept cookies or similar tracking technology. A cookie is a small amount of data that is sent to your browser from our Web server directly or using an authorized third party.
THIRD PARTY COOKIES
These cookies cannot be used to identify an individual; they can only be used for statistical purposes, for example, in providing you with advertisements that are more relevant to your interests. Some of the information gleaned from third party cookies will be aggregated with other anonymous information for statistical purposes. The third party companies that generate these cookies have their own, very strict, privacy policies but we don’t have access to these cookies; other than allowing them to be served, we have no role to play in these cookies at all (although we may use statistical information arising from these third party cookies and provided to us by third parties, to improve the targeting of advertisements to users of the website).
ARE COOKIES SAFE?
There are many misconceptions about cookies. Cookies cannot “steal” your personally identifiable information, and they cannot contain any personal information that you did not submit to the website that set the cookie. Also, one website cannot read another website’s cookies. Personal information that you enter at one website cannot be seen by another website.
YOUR PRIVACY WITH STORE’S WEBSITES
The Program website contains a number of links to stores’ web sites. We have not undertaken a review of the privacy policies or terms and conditions at such stores’ web sites, and we make no representations about the privacy policies or levels of security at these sites or the applicable terms and conditions. We are not responsible for the applicable terms and conditions or the privacy practices used by such stores.
The Program website takes commercially reasonable precautions consistent with general industry practices to protect Members’ information. When Members submit sensitive information via the Program website, we use our commercially reasonable efforts to ensure that their information is protected both online and off-line.
Information provided during our join or edit profile pages is encrypted and is protected with what is generally recognized as the best available encryption software in the industry – SSL. You will see the lock icon at the bottom of your browser and if you right click on the page, and view the page properties, you will see the site certificate. While we use SSL encryption to protect sensitive information online, we also use our commercially reasonable efforts consistent with general industry practices to protect user-information off-line. Members’ information, not just the sensitive information mentioned above, is restricted in our offices. Only individuals who have a need to know such information to perform a specific job (for example, customer service) are granted access to personally identifiable information. Furthermore, all such individuals are kept up-to-date on our security and privacy practices. When an employee is hired, as well as any time new policies are added, our employees are notified and/or reminded about the importance we place on privacy, and what they can do to ensure our members’ information is protected. Finally, the servers that store personally identifiable information are in a secure environment, off site. As a condition to using the Program, you represent that you are a person of legal age in the state in which you live. It is possible that by fraud, deception, or breach of our Program Terms and Conditions we may receive information given to us or pertaining to children under the age of thirteen (13). If we are notified of this, as soon as we verify the information, we will immediately delete the information from our servers. If you are a parent or legal guardian and think your child under the age of thirteen (13) has given us personal information, you can email us at email@example.com or contact us at the address listed below and request removal of any personal information. Please mark your inquiry “SPLENDER – MINOR PII REMOVAL REQUEST” to ensure it receives our immediate attention.
We will be sending you e-mails on a regular basis to advise you about your Program Account. Other service e-mails may be sent from the Program informing you of updates or changes to the network, etc. You also may receive additional emails, such as special promotions or other information which you may find to be of interest.
HOW TO UNSUBSCRIBE FROM COMMUNICATIONS
You occasionally may receive information regarding special offers and similar information related to the Program. Out of respect for the privacy of our members we present the option to not receive these types of communications via e-mail, go to My Account and change your marketing preferences.
We also will send you Program and service announcement updates. Note that you are not able to unsubscribe from service announcements, which contain important information about the Program and associated services. We communicate with members to provide requested services and address issues relating to their account via email with the information provided by the Member. It is your responsibility to keep such contact information current.
THIRD PARTY ADVERTISING
We may use third party advertising companies to serve ads when you visit our website. These companies use non-personally identifiable information regarding your visit to this website and other sites, such as the member IP address, pages viewed, date and time of your visit, or the number of times you have viewed an ad, to serve ads to you on this site and other sites that may be of interest to you. In the course of serving advertisements to this site, a third party advertiser may place or recognize a unique cookie on your browser.
We and our advertisers currently use third-party cookies and clear pixel GIFs (also referred to as “web beacons”) to measure page views on both the Program website and advertisers’ web sites and email responses. These devices allow us to identify unique visitors to the Program website, member visits to advertisers’ sites, and act as a counter for ongoing monitoring of Program website, email and corresponding future transaction activity related to a specific offer for both Splender and its advertisers. These commonly used counters collect absolutely no personal information and, as always, this technology is only used to enhance the program and make it more relevant to your personal interests.
INFORMATION COLLECTED VIA ONLINE SURVEYS, SWEEPSTAKES AND OTHER PROMOTIONS
We may occasionally provide you the opportunity to participate in contests, sweepstakes or surveys. If you choose to participate, we may request certain personally identifiable information from you.
Participation in these surveys or contests is completely voluntary and, therefore, you have a choice as to whether or not to disclose the request information. The requested information typically includes contact information (such as name and address) and/or demographic information (such as gender and zip code).
UPDATING YOUR INFORMATION
You can update your information by going to the My Account tab and clicking on the “My Profile” Link. Your changes will take effect immediately. If there is incorrect information listed for your Program Account, please Contact Us and our member services team will be happy to assist you.
It is your responsibility to comply with the Terms and Conditions of the Program. It also is your responsibility to update and maintain accurate contact information for your Program Account. You can make changes by visiting your My Account page and entering corrections or updates to your Program Account information, including your payment option. The email address that is entered into a member’s personal profile page is the one that will be used for all contact from us, and the information you enter for your payment option is what will be used for sending you any cash back payments that you have earned when payable as provided in the Terms and Conditions. We are not responsible for payments sent to an incorrect address or account due to outdated or incorrect information provided by you.
REFERRAL PROGRAM PRIVACY
If you choose to participate in the Referral Program to tell a friend about Splender, we will ask you or your friend for their name and email address. If we receive an email address, we automatically will send your friend a one-time email inviting him or her to join Splender. We would store this information solely to send the one-time email, match and award any earned referral bonuses to you and/or your friend, and track the success of our Referral Program. The referred individual may contact us at firstname.lastname@example.org to request that we remove this information from our database.
